NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED BY LAW.

These Official Rules govern the MTB:FC Launch Giveaway (the "Sweepstakes"). By entering, you agree to be bound by these Official Rules and by the decisions of the Sponsor, which are final and binding in all matters relating to the Sweepstakes.

1. Sponsor

The Sponsor and administrator of this Sweepstakes is MTB Acquisition, LLC, 442 S Main St, Unit #2102, Lombard, IL  60148 ("Sponsor"). The kayak awarded as the prize is furnished by Native Watercraft ("Prize Supplier"). The Prize Supplier is not a sponsor or administrator of this Sweepstakes and is not responsible for its conduct or administration.

2. Eligibility

The Sweepstakes is open only to natural persons who, at the time of entry, are (a) legal residents of one of the fifty (50) United States or the District of Columbia and (b) eighteen (18) years of age or older. Void in Puerto Rico, all other U.S. territories and possessions, and everywhere else outside the fifty United States and the District of Columbia, and void wherever otherwise prohibited or restricted by law.

Employees, officers, directors, members, managers, and agents of Sponsor and of the Prize Supplier, and the immediate family members (defined as spouse, domestic partner, parent, child, or sibling, whether by birth, marriage, or adoption) and members of the same household of any such person, are not eligible to enter or win.

No purchase, subscription, payment, or membership of any kind is required to enter or to win. Being a subscriber to any Sponsor product or service, or a member of any Sponsor online community, is neither required for entry nor an advantage in the Sweepstakes.

Sponsor reserves the right to verify the eligibility of any entrant at any time, and will verify the eligibility of the potential winner before awarding the prize. Any entry submitted by a person who does not meet all eligibility requirements is void, whether or not the ineligibility is discovered before or after the drawing.

3. Entry Period

The Sweepstakes begins on [START DATE] at [START TIME] [TIME ZONE] and ends on [END DATE] at [END TIME] [TIME ZONE] (the "Entry Period"). Entries submitted before or after the Entry Period will not be eligible. Sponsor's computer is the official timekeeping device for the Sweepstakes.

4. How to Enter

To enter, visit [ENTRY URL] during the Entry Period and submit a valid email address using the online entry form. Entry is free and requires no information other than a valid email address. This is the only method of entry.

By submitting an entry, each entrant represents and warrants that they meet all of the eligibility requirements set out in Section 2, and agrees to be bound by these Official Rules.

Limit one (1) entry per person for the entire Entry Period, and each eligible entrant receives one (1) entry in the drawing. No purchase, subscription, referral, share, or other action will increase the number of entries an entrant receives or improve an entrant's chances of winning.

Entries are identified by email address. If more than one entry is received from the same person or the same email address, only the first entry received will be eligible and all subsequent entries will be void. Sponsor may, in its sole discretion, disqualify all entries associated with any person who attempts to enter more than once, including by using multiple email addresses, aliases, or identities.

Entries generated by script, macro, bot, or any automated, robotic, or programmed means, and entries submitted through any method other than the online entry form described above, are void. Entries that are incomplete, illegible, corrupted, late, or otherwise not in compliance with these Official Rules are void. Entrants are responsible for providing an email address that they own and monitor; Sponsor is not responsible for entries submitted with an inaccurate, inaccessible, or non-functioning email address.

All entries become the property of Sponsor and will not be acknowledged or returned. Sponsor is not responsible for entries that are lost, late, misdirected, garbled, or not received for any reason, including technical failures of any kind.

5. Prize

One (1) prize will be awarded: one (1) Native Watercraft Slayer Propel 10 LTE Fishing Kayak, including shipping to the winner's address within the forty-eight (48) contiguous United States. Approximate Retail Value ("ARV"): $3,100.00.

Total ARV of all prizes: $3,100.00.

The difference, if any, between the stated ARV and the actual value of the prize at the time of award will not be awarded. The prize is awarded "as is" with no warranty or guarantee, either express or implied, by Sponsor, except as to any manufacturer's warranty that may accompany the kayak.

The prize is not transferable and no substitution or cash equivalent is available, except that Sponsor reserves the right, in its sole discretion, to substitute a prize of equal or greater value if the advertised prize becomes unavailable for any reason. The winner is responsible for all costs and expenses associated with prize acceptance and use that are not expressly stated in these Official Rules as being provided by Sponsor, including without limitation insurance, registration, licensing, storage, transport of the kayak after delivery, and all safety and personal protective equipment.

6. Odds of Winning

Odds of winning depend on the total number of eligible entries received during the Entry Period.

7. Winner Selection

On or about [DRAWING DATE], Sponsor or its designated representative will select one (1) potential winner in a random drawing from among all eligible entries received during the Entry Period. All decisions of Sponsor regarding winner selection are final and binding.

8. Winner Notification

The potential winner will be notified by email at the address submitted with their entry, within approximately 14 business days of the drawing. The potential winner must respond to the notification email within five (5) calendar days of the date it is sent.

If the potential winner does not respond within that period, cannot be contacted, is found to be ineligible, declines the prize, fails to comply with any requirement of these Official Rules, or if the notification email is returned as undeliverable, that potential winner forfeits the prize and Sponsor may, in its sole discretion, select an alternate potential winner by random drawing from among the remaining eligible entries. Sponsor will attempt to award the prize to no more than three (3) alternate potential winners, after which the prize may go unawarded.

9. Winner Requirements

Before the prize is awarded, the potential winner must provide their full legal name, date of birth, and a valid street address for delivery, and must complete, sign, and return to Sponsor the following documents within ten (10) calendar days of the date they are sent:

  • An Affidavit of Eligibility, confirming age and state of residence;

  • A Liability Release;

  • A Publicity Release, except where prohibited by law; and

  • A completed IRS Form W-9 (or, if applicable, other tax documentation reasonably requested by Sponsor).

Failure to return all required documents and information, properly completed and signed, within the stated period will result in forfeiture of the prize and selection of an alternate potential winner in accordance with Section 8. The potential winner is not confirmed as the winner until all required documents have been received and verified by Sponsor and the potential winner's eligibility has been confirmed.

10. Taxes

All federal, state, and local taxes on the prize, and any other costs and expenses associated with prize acceptance and use not expressly provided for in these Official Rules, are the sole responsibility of the winner. The value of the prize will be reported to the Internal Revenue Service on IRS Form 1099-MISC, and the winner will receive a copy. Winners are encouraged to consult their own tax advisor regarding the tax consequences of accepting the prize.

11. Prize Delivery

The prize will be shipped to a valid street address within the forty-eight (48) contiguous United States provided by the winner. Delivery cannot be made to a P.O. box. The winner is responsible for providing an address at which freight delivery can be accepted and for being available to accept delivery. Please allow approximately 12 weeks from confirmation of the winner for delivery. Sponsor is not responsible for delays, damage, or loss occurring during shipment by a third-party carrier. Sponsor will not re-ship or replace a prize that cannot be delivered because of an incorrect address or the winner's failure to accept delivery.

12. General Conditions

Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes, acting in violation of these Official Rules, or acting in a manner that is disruptive, fraudulent, or not in good faith. Any attempt by any person to deliberately undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and Sponsor reserves the right to seek damages and other remedies to the fullest extent permitted by law.

Sponsor reserves the right, in its sole discretion, to modify, suspend, terminate, or cancel the Sweepstakes, in whole or in part, if fraud, technical failure, human error, or any other cause beyond Sponsor's reasonable control, including without limitation acts of God, natural disaster, epidemic, labor dispute, or governmental action, corrupts or impairs the administration, security, fairness, or proper conduct of the Sweepstakes. In such event, Sponsor may, in its sole discretion, select the winner by random drawing from among all eligible non-suspect entries received prior to the event giving rise to the modification, suspension, termination, or cancellation.

Sponsor is not responsible for any typographical or other error in the printing, offering, or announcement of any prize or in the administration of the Sweepstakes.

If any provision of these Official Rules is held to be invalid or unenforceable, that provision will be severed and the remaining provisions will remain in full force and effect.

13. Release and Limitation of Liability

By entering, each entrant releases and agrees to hold harmless Sponsor, the Prize Supplier, and each of their respective parents, subsidiaries, affiliates, officers, directors, members, managers, employees, agents, and representatives (collectively, the "Released Parties") from and against any and all claims, damages, losses, liabilities, injuries, and expenses of any kind — including personal injury, death, and property damage, arising out of or relating to participation in the Sweepstakes, the acceptance, receipt, possession, use, or misuse of the prize, or any travel or activity related to the prize.

The winner acknowledges that kayaking and other water activities involve inherent risks, including the risk of serious injury and death, and assumes all such risks. The winner is solely responsible for the safe use of the prize, including compliance with all applicable laws and the use of appropriate personal flotation devices and other safety equipment.

In no event will the Released Parties be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages arising out of or relating to the Sweepstakes, whether based in contract, tort, or any other theory of liability, even if advised of the possibility of such damages. Each entrant's sole and exclusive remedy, and the Released Parties' total aggregate liability, is limited to the actual out-of-pocket costs incurred by the entrant in entering the Sweepstakes, which the entrant acknowledges may be zero.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to all entrants.

14. Publicity

Except where prohibited by law, by participating in the Sweepstakes each entrant consents to Sponsor's use of their name, city and state of residence, photograph, voice, likeness, and statements about the Sweepstakes for advertising, promotional, and publicity purposes in any and all media now known or hereafter developed, worldwide and in perpetuity, without further notice, compensation, review, or approval.

15. Privacy

Information submitted in connection with the Sweepstakes will be collected and used by Sponsor for the purpose of administering the Sweepstakes and awarding the prize, and otherwise in accordance with Sponsor's Privacy Policy, available at https://mysterytacklebox.com/pages/privacy-policy, which is incorporated into these Official Rules by reference. [IF APPLICABLE: By entering, entrants will also be added to Sponsor's email list and may receive marketing communications from Sponsor. Entrants may unsubscribe at any time using the link in any such email. Unsubscribing does not affect an entrant's entry or chances of winning.]

16. Disputes; Governing Law; Binding Arbitration; Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND TO PARTICIPATE IN A CLASS ACTION.

Governing law. These Official Rules and all matters arising out of or relating to the Sweepstakes are governed by the laws of the State of IL, without regard to its conflict of laws principles.

Binding arbitration. Except as set out below, any dispute, claim, or controversy arising out of or relating to the Sweepstakes, the prize, or these Official Rules, including the validity, enforceability, or scope of this Section will be resolved exclusively by final and binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect, rather than in court. The arbitration will be conducted before a single arbitrator. Judgment on the award may be entered in any court of competent jurisdiction. By entering, each entrant waives the right to a trial by jury.

Class action waiver. ALL DISPUTES MUST BE BROUGHT IN THE PARTIES' INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE THE CLAIMS OF MORE THAN ONE PERSON AND MAY NOT PRESIDE OVER ANY FORM OF CLASS OR REPRESENTATIVE PROCEEDING. If this class action waiver is found to be unenforceable as to any particular claim, that claim will be severed from the arbitration and brought in the courts identified below.

Exceptions. Either party may bring an individual claim in small claims court if it qualifies. Either party may also seek injunctive or other equitable relief in a court of competent jurisdiction to protect its intellectual property rights or to prevent the unauthorized access to or misuse of the Sweepstakes.

Venue for non-arbitrable claims. For any dispute not subject to arbitration, the parties consent to the exclusive jurisdiction and venue of the state and federal courts located in DuPage County, IL.

Limitations. Each entrant agrees that any claim arising out of or relating to the Sweepstakes must be brought within one (1) year after the claim arises, or it is permanently barred. Each entrant further agrees that no award will include attorneys' fees or any relief other than actual out-of-pocket damages, and expressly waives any right to seek punitive, incidental, consequential, or multiplied damages.

17. Winner List

For the name of the winner, send a written request together with a self-addressed stamped envelope to: MTB Acquisition, LLC, Attn: Marketing Department - MTB:FC Launch Giveaway Winner List, 442 S Main St, Unit #2102, Lombard, IL  60148. Requests must be received by December 31, 2026.

18. Not Sponsored by Meta

This promotion is in no way sponsored, endorsed, administered by, or associated with Meta Platforms, Inc. or Facebook. You are providing your information to MTB Acquisition, LLC, not to Meta. Meta is released from all liability in connection with this Sweepstakes. Any questions, comments, or complaints regarding the Sweepstakes must be directed to Sponsor, not to Meta.
